Terms and Conditions (as of 11/20)
§ 1 General Terms
The following general terms and conditions apply to all deliveries between Electric Roots (us) and a consumer (you) in the version valid at time of order.
A consumer is any natural person who concludes a legal transaction for purposes that can largely not be attributed to their commercial or independent professional activity (§13 BGB). (PLEASE NOTE: All our DIY Kits and PCBs are meant for private use only. If you want to use any of our products commercially please contact us via email at firstname.lastname@example.org.)
The following regulations regarding the conclusion of a contract apply to orders placed via our web shop www.electric-roots.com or via email in case of a custom commission.
In case of the conclusion of contract, the contract results with Electric Roots, Inh. Chris Roots, Oberstr. 3, 47829 Krefeld, Germany. Contract languages available are English and German only.
The presentation of goods in our web shop does not constitute a legally binding contract offer on our part but is only a non-binding invitation to you to order goods. By ordering the desired goods, you submit a binding offer to conclude a purchase contract.
§ 2 When a regular order is received in our web shop the following rules apply
You submit a binding contract offer by successfully completing the order process provided in our web shop. The order takes place in the following steps: Selection of desired goods by clicking the “add to cart” button, check selected goods in shopping cart, continue to checkout page by clicking the “proceed to checkout” button, fill in personal data and make a binding purchase by clicking the button “proceed to PayPal”. Shortly after you will receive an order confirmation email from PayPal stating that you have successfully paid for and hereby completed your order.
In accordance with §19 UStG the prices shown on our web shop do not include statutory sales tax. Any shipping and packaging costs are added to the value of your ordered goods. On international orders, import duty and taxes (where applicable) are to be paid by yourself.
Unless we have clearly stated otherwise in the product description, all items we offer are available for immediate dispatch. Delivery takes place within 10 working days starting the day after the contract is concluded. If the period ends on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.
We reserve ownership of the goods until full payment of the purchase price including additional fees such as shipping costs. See PayPal’s Terms and Conditions for paying through PayPal.
§ 3 When a commission order is received in our web shop the following rules apply
You submit a commission request by successfully filling out the commissions form via our custom shop. Shortly after you will receive an email summary about your request. We will review your request and get back to you with any questions that may arise.
When all questions are cleared, we will then send you a quotation email for your custom pedal via PayPal including technical and design specifications, full price, delivery time and shipping costs. Please read this quotation carefully and check back with us for any questions you might have (there is a message field on top of the quotation). By accepting our quotation you submit a binding contract offer. Shortly after you will receive an order confirmation email from PayPal asking you to complete your order by paying the final estimated cost as given in the quotation.
In accordance with §19 UStG the prices shown on individual quotations do not include statutory sales tax. Any shipping and packaging costs are added to the value of your ordered goods. On international orders, import duty and taxes (where applicable) are to be paid by yourself. We reserve ownership of the goods until full payment of the purchase price including additional fees such as shipping costs.
§ 4a Cancellation Policy for regular orders
You have the right to cancel this contract within 14 days after receiving your goods without giving any reason. This right of withdrawal relates only to non-commission products and excludes any individually made custom items. To exercise your right of withdrawal you must contact us at Electric Roots, Ihn. Chris Roots, Oberstr. 3, 47829 Krefeld, Germany or via email@example.com and inform us of your decision to cancel this contract by means of a clear written statement (you can use the attached model withdrawal form, if you like).
PLEASE NOTE: After informing us about your cancellation, you will be provided with a return address. Only items that are shipped to this specific address can be subject to our cancellation policy! If you have returned your items to another address, any additional costs that occur due to our internal logistic systems will be deducted from your refund.
If you cancel this contract, we will repay the full price of your purchased items (excluding any additional fees like shipping costs) within 14 days from the day on which we have received the notification of your cancellation. For this repayment we will use the same means of payment that you used in the original transaction.
We can refuse repayment until we have received and examined the goods. Should there be any technical or cosmetic defects to the goods, we will reduce the repaid price according to the damage found. You must return the goods intact and with tracked delivery at your own cost no later than 14 days from the day on which you inform us about the cancellation of this contract. The deadline is met if you send the goods before the 14-day-period has expired.
§ 4b Cancellation Policy for commission orders
If you wish to cancel this contract before the manufacturing of your commission order or custom item is completed, a cancellation charge of at least 50% of the final estimated cost as given in your quotation will be payable depending on the state of manufacture at the time of cancellation. This will be considered on a case by case basis at our own discretion. Completed commission orders and custom items are not subject to our Cancellation Policy.
If you wish to return a commission order or custom item after we have completed manufacturing your order, please send us an email via firstname.lastname@example.org with your Commission Order No. and reason for cancellation. Our customer service will work to find a solution for you even though we cannot guarantee any refunds.
§ 4c Model withdrawal form

German statutory warranty regulations apply.
